一、坊間推銷行為類型:
1.強迫推銷:在校園、宿舍或教室強迫推銷書籍、課程、學習軟體、語言課程、電腦週邊等商品。
2.不當宣傳:擅自發送傳單、招募人員或舉辦講座。
3.個人資料蒐集:以問卷、心理測驗、試用產品或小禮物為誘餌,蒐集學生個人資料。
4.信用卡/貸款: 誘導學生申辦信用卡或簽署不合理的貸款、分期付款合約。
二、師生應對措施:
1.直接拒絕:遇到校外人士推銷時,明確表達「不需要」,不要因不好意思而收下物品或簽名。
2.不填個資:絕對不要在來歷不明的問卷上填寫姓名、電話、校系、住址等隱私資料。
3.立刻通報:遇到強迫推銷情形,可立即致電校安中心反映,校安中心專線電話:04*26338000。
不接受陌生人提供的商品或服務,避免被誘導簽訂不合理合約。
三、因類案均屬訪問交易,依據消費者保護法第19條:針對校園內常見的推銷行為(通常屬於訪問交易),您可以主張以下重要權利:
(一)七日無條件解約權(鑑賞期):
1.無需理由: 只要是在非營業場所(如校園、路邊)進行的交易,消費者可以在收受商品或接受服務後7日內,退回商品或以書面通知方式解除契約。
2.無需負擔任何費用: 您不需要說明理由,也不必負擔任何費用(如手續費、退貨運費或折舊費)。
(二)關於「拆封」的限制:
推銷員常宣稱「包裝已拆不能退」,但在訪問交易中,為了檢查商品而拆封是合理的。只要不是人為故意破壞,仍享有退貨權利。
(三)書面告知義務:
1.企業經營者在交易時,應將解約退貨的權利及行使期限以書面告知消費者。
2.時效延長:如果對方沒有告知您有「7日退貨權」,則 7 日的起算日會延後,最長可達4個月。
(四)契約解除後的法律效果:
1.契約解除後,雙方負有回復原狀的義務(你還貨、他退錢)。
2.若您是被誘導簽署了分期付款或信貸合約,主契約解除後,相關的消費貸款合約也應一併處理。

一、Common Types of Off-Campus Solicitation:
1. High-Pressure Sales: Forced selling of books, online courses, learning software, language programs, or computer peripherals in classrooms, dorms, or around campus.
2. Unauthorized Promotion: Distributing flyers, recruiting personnel, or holding seminars without university approval.
3. Data Harvesting: Using surveys, psychological tests, product trials, or small gifts as \”bait\” to collect students\’ personal information.
4. Credit Cards & Loans: Inducing students to apply for credit cards or sign unfair loan/installment agreements.
二、Response Measures for Faculty and Students
1.Direct Refusal: When approached, say \”No, thank you\” clearly. Do not accept items or sign anything out of politeness.
2.Protect Personal Data: Never provide your name, phone number, department, or address on suspicious questionnaires.
3.Immediate Reporting: If you encounter aggressive sales tactics, contact the Campus Security Center immediately at 04-26338000.
4.Avoid Entrapment: Do not accept free goods or services from strangers to avoid being pressured into unfair contracts.
三、Your Rights Under the Consumer Protection Act (Article 19)
Most campus sales qualify as \”Door-to-Door Sales\” (unsolicited trades). Under the law, you have the following rights:
(一)7-Day Unconditional Right of Rescission (Cooling-off Period)
1.No Reason Required: For transactions made in non-business locations (campuses, streets), you may return the product or cancel the contract in writing within 7 days of receipt.
2.Zero Cost: You do not need to provide a reason or pay any fees (handling fees, return shipping, or depreciation).
(二) Regarding \”Unboxing\” Restrictions
Salespeople often claim that \”opened packages cannot be returned.\” However, in door-to-door sales, opening a package to inspect the product is legally protected. As long as the product isn\’t intentionally damaged, you retain your return rights.
(三) Obligation of Written Notice
1.Business operators must inform consumers in writing of their right to cancel and the time limit for doing so.
2.Extension of Rights: If the seller fails to inform you of the 7-day return policy, the 7-day period is extended and can last up to 4 months.
(四) Legal Effects of Cancellation
1.Once the contract is rescinded, both parties must restore the status quo (you return the goods, they refund the money).
2.If you were induced to sign an installment or credit loan agreement, the loan contract should be terminated along with the main purchase agreement.
