校安中心跟蹤騷擾防制法宣導-《跟蹤騷擾防制法》旨在保護個人身心安全與行動自由。依據法條規定,判斷是否構成「跟蹤騷擾行為」,必須同時符合四大構成要件與八大法定行為樣態之一。 Campus Safety Center Anti-Stalking and Harassment Awareness Campaign The Stalking and Harassment Prevention Act aims to protect individual physical and mental safety, as well as personal freedom of movement. According to statutory provisions, a behavior must meet all of the following four core elements and involve at least one of the eight statutory behavioral patterns to be legally recognized as “stalking and harassment.”

一、四大構成要件

  1. 反覆或持續: 必須是重複或連續發生的行為,偶然一次或零星的舉動通常不成立。重點在於行為人漠視被害人的拒絕意願。
  2. 違反被害人意願: 被害人已明確表達拒絕(如拒絕約會、已讀不回、口頭制止),行為人仍執意進行。
  3. 與性或性別有關: 行為動機涉及愛慕、追求、性別偏見或情感糾葛等。若單純為債務糾紛或鄰居口角,則適用其他法律。
  4. 使人心生畏怖,影響生活: 行為造成當事人心理恐懼、壓迫感,並足以影響其日常生活、工作或社交。

二、八大行為樣態

只要符合上述要件,並涉及以下其中一種行為,即可能觸法:

  1. 監視觀察: 監視、跟蹤或探知特定人行蹤。
  2. 盯梢尾隨: 守候、尾隨或盯梢出沒於被害人的住處、學校、工作場所等。
  3. 歧視貶抑: 對被害人為嘲弄、辱罵、歧視、仇恨或貶抑。
  4. 通訊騷擾: 使用電話、傳真、網路等設備持續干擾。
  5. 不當追求: 不斷要求約會、聯絡或其他追求行為。
  6. 寄送物品: 未經請求,強行寄送、留置或播送物品、影像給被害人。
  7. 妨害名譽: 散布或出示有害被害人名譽的訊息與物品。
  8. 冒用個資: 未經同意濫用被害人資料,冒名訂購貨品或服務。

三、應對與保護機制

若您遇到跟蹤騷擾,請立即撥打 110 報警,警方將介入調查:

1.書面告誡: 警方可依職權或被害人請求核發書面告誡予加害人。

2.保護令: 告誡後若兩年內再犯,被害人可直接向法院聲請保護令。

3.刑事責任: 一般跟騷行為可處 1 年以下有期徒刑;若攜帶凶器或危險物品,則加重至 5 年以下有期徒刑。

4.若對方為本校學生,且涉及性與性別有關,可以向學校性別平等委員會申訴。

一. The Four Core Elements

1.Repeated or Continuous Actions: The behavior must be repetitive or continuous. One-off or isolated incidents generally do not qualify. The key factor is that the perpetrator disregards the victim’s rejection.

2.Against the Victim’s Will: The victim has clearly expressed rejection (e.g., declining dates, ignoring messages, verbal warnings), yet the perpetrator persists.

3.Related to Sex or Gender: The motivation involves infatuation, pursuit, gender bias, or emotional disputes. Purely financial disputes or neighbor arguments fall under other laws.

4.Causing Fear and Impacting Daily Life: The behavior causes psychological fear or a sense of oppression, sufficiently disrupting the victim’s daily life, work, or social activities.

二. The Eight Statutory Behavioral Patterns

If the above elements are met, engaging in any of the following behaviors may violate the law:

1.Surveillance and Observation: Monitoring, stalking, or tracing the whereabouts of a specific person.

2.Stalking and Loitering: Waiting, tailing, or loitering near the victim’s residence, school, workplace, etc.

3.Discrimination and Disparagement: Mocking, verbally abusing, discriminating against, hating, or disparaging the victim.

4.Communication Harassment: Constantly disturbing the victim via phone, fax, internet, or other devices.

5.Inappropriate Pursuit: Repeatedly demanding dates, communication, or other forms of pursuit.

6.Sending Unwanted Items: Forcibly sending, leaving behind, or broadcasting items or images to the victim without request.

7.Defamation: Distributing or displaying messages and objects that harm the victim’s reputation.

8.Misuse of Personal Data: Misusing the victim’s personal data without consent to order goods or services under their name.

三. Response and Protection Mechanisms

If you experience stalking or harassment, please call 110 immediately to report it to the police, who will initiate an investigation:

1.Written Warning: The police may issue a formal written warning to the perpetrator upon their own authority or at the victim’s request.

2.Protection Order: If the perpetrator offenses again within two years after the written warning, the victim can apply directly to the court for a protection order.

3.Criminal Liability: Standard stalking and harassment behaviors are punishable by up to 1 year in prison. If the perpetrator carries a weapon or dangerous object, the penalty increases to up to 5 years in prison.

4.Campus Reporting: If the perpetrator is a student of this university and the incident is related to sex or gender, a complaint can be filed with the university’s Gender Equity Education Committee.
